In recent years, small businesses in the hospitality industry, and private campgrounds and ski areas in particular, have been the target of lawsuits alleging that their websites and/or mobile applications are in violation of the ADA and New York Human Rights Law, because they do not provide access to visually and/or hearing-impaired individuals. To date, there is no federal regulation that specifies what qualifies a website or mobile application as compliant. The vague nature of the existing guidance leaves an entire industry vulnerable to these lawsuits, partic- ularly those that are ill-equipped to defend themselves against such suits. This legislation would provide businesses with an opportunity to correct any alleged violation prior to the commencement of an action, by providing them sixty days in which to "cure" a potential violation and communicate those corrections to the claimant. In the absence of action from the Department of Justice, this bill will go far in providing relief to these companies that are frequently settling out of court for large sums of money.
